AFSCME appeared on February 28, 2013 at a hearing before the Assembly Committee on Government Affairs and opposed the bill as written, specifically focusing on sections that give the City Manager the expanded ability to create positions identified in the bill as "appointed positions" which would not be subject to either collective bargaining agreements or protections under the City's Civil Service Code.

This bill protects an employee who reports an OSHA violation about his workplace, and then suffers discrimination from his employer after the OSHA complaint has been filed; it removes a Nevada statutory requirement that the employee that the employee notify his or her employer first before reporting the discriminatory retaliation to the Division of Industrial Relations, making Nevada's law compliant with federal OSHA statutes. The bill passed out of the Assembly on March 12, 2013.

Note:  AFSCME initially opposed this bill has written, which gave the "Employee Management Relations Board" (the board that hears unfair labor practice complaints) an open-ended time limit to schedule a hearing once the EMRB took jurisdiction of a claim, by removing a 90 day time limit. We appeared at the hearing on the bill on February 11, 2013 before the Assembly Committee on Government Affairs to oppose; after the hearing an amendment was proposed and accepted, allowing a 180 day window instead of removing the timeframe altogether. The bill was amended and passed out of Committee on March 4, 2013.

Though the proponents of the bill argued that the IT personnel they use in their businesses make substantial incomes and "don't need" to be paid overtime pursuant to federal and state law, we argued that the bill has presently written could affect IT workers in public service, who for the most part make significantly less than private sector IT workers.
